WHAT IS COOKIE POLICY?

A cookie is a small text file that a website stores on your computer or mobile device when you visit the site.

Institutions and organizations must obtain the "explicit consent" of the users in order to use cookies effectively on their websites. Users can determine and change their preferences regarding the use of cookies. Some institutions and organizations reserve the right to request the deletion of cookies in their cookie policies.

The principle of explicit consent, which is an innovation brought by the GDPR, is also applicable in Turkish law by data controllers in the form of notification and disclosure to individuals in accordance with KVKK No. 6698. According to the Personal Data Protection Law, information should be given to the people before the explicit consent for the use of cookies, and the express consent must be given freely by the people. Explicit consent should not be positioned as a prerequisite for providing a service.

You can see the importance of the Cookie Policy in terms of KVKK in its Decision dated 27/02/2020 and numbered 2020/173. According to the decision;

In the text of the “Privacy Statement”, the data controller states, “You may choose not to provide certain information, but in this case you will not be able to use most of the Amazon Services.” or “If you block or reject our cookies, you will not be able to add items to your shopping cart, proceed to purchase, or use any Amazon service that requires you to sign in.” by stating that the processing of personal data is conditional on service, obtaining explicit consent and imposing express consent as a condition of membership and service, therefore of the contract; In the presence of other personal data processing conditions, it is considered that the data controller will abuse the right due to mislead and misdirection of the data subject, and that the fact that the service is subject to the express consent condition will injure the express consent. It has been evaluated that it violates the principles of being bound, limited and proportional.

As a result of the evaluations of the institution, it was decided to impose an administrative fine of 1,100,000 TL on the institution.

In the event that institutions and organizations provide services to EU countries, the rules of both KVKK and GDPR regarding the use of cookies should be applied.
